The Council of Ministers approved a draft of a new Law for the Concessions

The new Law for the Concessions establishes equal order for submission of concessions by the state and the municipalities and regulates the common framework of the conditions and the order for submission, implementation and termination of the concessions. That was the statement of the Minister of Regional Development and Public Works Asen Gagauzov after the approval of the draft Law by the Council of Ministers. According to its subject the new Law divides the concessions in three types: for construction, services and production. Unlike the Law for the Concessions now in force the draft Law does not envisage possibility for prolongation of the concession deadline and does not contain an Order according to which at the end of the concession term in equal other conditions the concessionaire has advantage to the other candidates. This legislative approach is defined by the requirements in defense of the basic principle of the market economy – the competition. It is envisaged that the procedure for submission of concession start with a Resolution of the Council of Ministers or accordingly of the Municipality Council. The procedure for submission of concession can be conducted in one of the four forms defined by the Law – an open procedure, restricted procedure, competitive dialogue and electronic tender as additional procedure at an open or restricted procedure. In the transitional and conclusion Orders of the draft Law is envisaged that the Council of Ministers approve a Regulation to define its overall implementation.
